How is a divorce action filed in Antalya?
A divorce action is filed with the Antalya Family Court at the place of residence of either spouse. An uncontested divorce requires at least one year of marriage and a protocol agreed by both parties. In a contested divorce, claims concerning fault, division of property, alimony, custody and compensation are set out in the petition. Legal advice is recommended before proceedings begin.
How is severance pay calculated?
Severance pay amounts to one month of the employee's final gross salary including fringe benefits for each full year of service, with partial years calculated proportionally. Entitlement requires at least one year of service and either dismissal without just cause or resignation on a ground recognised by the Labour Law. The statutory ceiling is revised each year.
Is legal representation mandatory in criminal cases?
As a general rule representation is not compulsory under Turkish law. It is, however, mandatory for offences carrying a lower limit of more than five years' imprisonment and in certain situations, including where the suspect is a minor, has a hearing or speech impairment, or is otherwise unable to conduct a defence. Legal assistance during the investigation and trial stages is nevertheless of considerable importance.
How are legal fees determined?
Fees are set in accordance with the Minimum Fee Tariff published each year by the Union of Turkish Bar Associations, below which no fee may be agreed. The amount varies with the type of matter, its complexity, the number of parties and its expected duration. A written fee agreement is drawn up for each file.
Can foreign nationals buy property in Turkey?
Yes, subject to certain restrictions. Although the reciprocity requirement has largely been lifted, rules remain in force concerning military prohibited zones, purchases exceeding ten per cent of the surface area of a district, and a limit of thirty hectares per person. Acquisition of property at or above the threshold set by legislation may also open the exceptional route to Turkish citizenship.
