Divorce Proceedings in Turkey
Divorce actions are heard by the Family Courts at the place of residence of either spouse or at the couple's last shared residence. Turkish law recognises two routes: uncontested divorce, which requires at least one year of marriage and a protocol agreed by both spouses, and contested divorce, where fault, financial claims and custody are examined by the court.
In a contested case the petition sets out the ground for divorce together with claims for alimony, custody, division of property and compensation. Evidence such as witness statements, correspondence and financial records is examined during the proceedings.
Divorce decrees issued by foreign courts do not take effect in Turkey automatically. They must first be recognised or enforced through a separate action, or registered through the simplified administrative procedure where its conditions are met.
