Consumer law protects the purchaser of goods and services, who stands in a weaker economic position than the seller or producer. The Law on the Protection of Consumers no. 6502 and the related regulations form the core legislation.

Consumer Law in Turkey

The field covers defective goods and services, distance contracts, instalment sales, financial services, timeshare arrangements, package tours and consumer credit.

Jurisdiction depends on the amount in dispute. Claims below the statutory threshold are heard by the Consumer Arbitration Committees, and those above it by the Consumer Courts. The thresholds are revised each year.

Application to the arbitration committee is free of charge and does not require representation, although the decision may be challenged before the Consumer Court.

What a Consumer Lawyer Handles

1

Consumer Court Claims

Proceedings concerning defective goods and services, warranties, refunds and withdrawal rights.

2

Vehicle Diminished Value

Recovery from the insurer or the liable party of the loss in value of a vehicle after an accident.

3

Defective Goods and Services

Claims for a refund, replacement or compensation where the goods or services are defective.

4

Banking and Financial Services

Disputes concerning unlawful deductions, file charges, card fees and credit agreement terms.

In Summary

Consumer legislation grants extensive rights, but each of them is tied to a period that begins to run on delivery or on discovery of the defect. Keeping invoices and correspondence is therefore important.
