Criminal Proceedings in Turkey
A criminal case passes through two stages. The investigation stage is conducted by the public prosecutor and, where sufficient suspicion is established, an indictment is filed. The prosecution stage then takes place before the competent criminal court.
Depending on the offence, the case is heard either by the Criminal Court of First Instance or, for offences carrying heavier sentences, by the Assize Court. Appeals lie to the regional courts of appeal and, in defined circumstances, to the Court of Cassation.
Assistance of counsel is not compulsory as a general rule. It is, however, mandatory for offences carrying a lower limit of more than five years' imprisonment and for suspects who are minors, who have a hearing or speech impairment, or who are otherwise unable to conduct their own defence.
